Observation

The licensor conducted interviews of staff and the child’s parent and watched the video of the incident. While the staff member did have a hand on the child, the staff member was distracted as she bent down to pick up shoes off the floor. During this distraction, the child was able to lean forward and fall off the table despite having a hand on the child. For this reason, the licensor finds this allegation likely valid. Dispute Description: I do not agree with licensors finding of non-compliance of WAC number 110-300-0345 (5)(d) because the child was never left unattended during diaper changing. There was a staff present and per video her hand was on the child the whole time. We should not be found for non-compliance. The teacher was able to see or hear the child, they were responsible for at all times. We understand this could have been worse than it really was, and we take pride in making sure our center and staff know the WAC and how to properly tend to children. We have taken appropriate steps to ensure that something like this doesn’t happen again. Also when parents read this they will think we were not with the child when he fell, they will not know the circumstances and will think the worse.
